These Terms and Conditions set out the basis on which Rubbish Removal Pimlico provides rubbish removal and related waste collection services to residential and commercial customers. By booking or using our services, you agree to be bound by these Terms and Conditions, which form a legally binding agreement between you and us. Please read them carefully before placing a booking.
If you do not agree with any part of these Terms and Conditions, you should not proceed with your booking or use our services.
In these Terms and Conditions, the following expressions have the meanings set out below:
1.1 Service means any rubbish removal, waste collection, clearance, loading, lifting, transportation, recycling or disposal service carried out by us.
1.2 We, us or our means the operator trading as Rubbish Removal Pimlico.
1.3 You or your means the customer who books or uses the Service, whether as an individual, business, landlord, tenant, property manager or other organisation.
1.4 Premises means the property, building, land or location at which the Service is to be provided.
1.5 Waste or Rubbish means the items, materials or substances to be removed or collected as part of the Service, excluding any prohibited or hazardous items as described in these Terms and Conditions.
2.1 We provide rubbish removal and waste collection services, including but not limited to household clearances, office clearances, bulky waste removal and general waste collections.
2.2 We reserve the right to refuse to remove any Waste that we reasonably believe is hazardous, illegal, excessively heavy, unsafe to handle, or not properly described at the time of booking.
2.3 We will carry out the Service with reasonable care and skill and in accordance with applicable waste management laws and regulations in the United Kingdom.
2.4 We are not responsible for carrying out any cleaning, repair or restoration works at the Premises after the removal of Waste, unless expressly agreed in writing.
3.1 You may request a booking for the Service by telephone, email or other contact method we make available. When making a booking, you must provide accurate details, including:
(a) Your full name and contact information.
(b) The address of the Premises.
(c) A description of the Waste to be removed, including approximate volumes, types of items and any access restrictions.
3.2 Any quotation provided prior to our arrival at the Premises is an estimate only and is based on the information you have supplied. We may adjust the price on site if the actual nature or volume of Waste differs from your description.
3.3 Your booking is not confirmed until we have accepted it and communicated a booking time or time window to you. We reserve the right to decline any booking request at our discretion.
3.4 You are responsible for ensuring that an authorised person is present at the Premises at the agreed time to provide access, confirm the scope of the Service and accept any revised quotation where applicable.
4.1 You must ensure safe, reasonable and lawful access to the Premises on the date of the Service, including any necessary access codes, gate permissions or entry instructions.
4.2 You are responsible for obtaining any parking permissions, permits or dispensations that may be required to allow our vehicles to park near the Premises. Any penalty charge notices or similar fines arising from your failure to arrange suitable parking may be charged to you.
4.3 If we are unable to access the Premises, or if there are significant delays caused by access restrictions, we may charge a waiting time fee or, in some cases, treat the booking as cancelled by you and apply the relevant cancellation charges.
5.1 Our prices are generally based on the volume, weight and type of Waste, as well as access conditions, labour involved and any additional services required.
5.2 Unless stated otherwise, prices quoted are inclusive of standard disposal and recycling charges, but may exclude additional fees for special or difficult items, excessive weight or non-standard disposal routes.
5.3 We will confirm the final price for the Service with you on site before commencing work, where the Waste can be inspected directly. By agreeing to proceed, you accept the final price.
5.4 Payment is due on completion of the Service, unless we have agreed alternative payment terms in writing in advance. We may accept payment by cash, card or bank transfer, subject to availability of each option.
5.5 For business clients with agreed credit terms, payment is due within the period stated on the invoice. We reserve the right to charge interest and administrative fees on late payments in accordance with applicable law.
5.6 All Waste remains your responsibility until full payment has been received and the Service is completed. If payment is not made, we may decline to remove the Waste or may return the Waste to the Premises or another location by agreement.
6.1 You may cancel or amend your booking by contacting us as soon as possible.
6.2 If you cancel more than 24 hours before the scheduled booking time, no cancellation fee will usually apply, unless we have incurred specific costs in preparation for your Service.
6.3 If you cancel within 24 hours of the booking time, or if you fail to provide access to the Premises at the agreed time, we may charge a cancellation or call-out fee to cover our reasonable costs, including travel, labour and lost opportunity.
6.4 We may cancel or reschedule your booking if we are unable to provide the Service due to circumstances beyond our reasonable control, such as severe weather, road closures, vehicle breakdown, staff illness or legal restrictions. In such cases, we will endeavour to offer an alternative booking time. We will not be liable for any loss you may suffer as a result of such cancellation or rescheduling, other than a refund of any amount you have already paid for the Service that we do not provide.
7.1 You are responsible for ensuring that all Waste to be removed is clearly identified and separate from items that you wish to retain. Our staff accept no liability for removing items that you have not clearly indicated should remain.
7.2 You must ensure that any fragile, valuable or sensitive items are removed from the immediate working area or clearly marked as not for removal.
7.3 You confirm that you have full authority to request the removal of the Waste from the Premises, whether as owner, tenant, landlord, agent or otherwise. You agree to indemnify us against any claim from a third party alleging that the removal of any item was not authorised.
7.4 You must not permit any person other than our staff to load or interfere with our vehicle or equipment during the Service.
8.1 We handle a wide range of general household and commercial Waste, including furniture, appliances, packaging, garden waste and general non-hazardous rubbish.
8.2 Certain items are restricted or prohibited and may not be collected as part of a standard Service. These may include, without limitation:
(a) Asbestos or materials containing asbestos.
(b) Clinical or medical waste, syringes or pharmaceuticals.
(c) Chemical, corrosive or toxic substances.
(d) Gas bottles, fuel, oil or other flammable liquids.
(e) Explosives or weapons.
(f) Paints, solvents or other hazardous liquids, except where agreed in advance and correctly contained.
8.3 If we encounter prohibited or hazardous items that were not disclosed at the time of booking, we may refuse to remove them and may charge a fee for any time spent on site, or for any specialist arrangements made.
8.4 You are responsible for informing us in advance of any materials that may present a health and safety risk to our staff or the public.
9.1 We operate in accordance with relevant waste management legislation and duty of care requirements applicable in the United Kingdom.
9.2 We will dispose of or recycle Waste only at authorised facilities. We will take reasonable steps to maximise recycling and diversion from landfill, subject to the nature of the Waste and local infrastructure.
9.3 Upon request, and where applicable, we may provide details of our waste carrier registration or other regulatory credentials.
9.4 Once Waste has been collected and loaded onto our vehicle, it becomes our responsibility and we will handle it in compliance with applicable regulations.
10.1 We will exercise reasonable care and skill in delivering the Service. However, our liability to you is limited as set out in this section.
10.2 We will not be liable for any loss or damage arising from:
(a) Your failure to clearly separate Waste from items not intended for removal.
(b) Pre-existing defects to the Premises, fixtures or fittings.
(c) Normal wear and tear, minor scuffs or marks reasonably associated with moving bulky items.
(d) Events outside our reasonable control.
10.3 If damage occurs to the Premises as a direct result of our negligence, you must notify us in writing as soon as reasonably practicable and, in any event, within 48 hours of completion of the Service. We may request photographs, access for inspection and cooperation with our insurers.
10.4 To the fullest extent permitted by law, our total liability to you for any claim arising under or in connection with the Service, whether in contract, tort or otherwise, shall be limited to the total price paid or payable by you for the specific Service in question.
10.5 We shall not be liable for any indirect, consequential or economic loss, including loss of profits, loss of business, loss of opportunity or loss of enjoyment.
10.6 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.
11.1 We maintain insurance cover that is appropriate for the nature of our rubbish removal activities, including public liability insurance, subject to policy terms, conditions and exclusions.
11.2 Our insurance may not cover damage to items of particularly high value, fragile items such as antiques, fine art or specialist equipment, unless specifically agreed and declared in advance. You should arrange your own insurance cover for such items if necessary.
12.1 If you are dissatisfied with any aspect of the Service, you should contact us promptly with full details of your concern so that we have an opportunity to investigate and respond.
12.2 We aim to deal with complaints fairly and quickly. We may request further information or evidence from you to help us assess the matter.
12.3 If a dispute cannot be resolved through our internal complaints procedure, you may have the right to pursue the matter through the courts or, where applicable, any alternative dispute resolution scheme that we agree to participate in.
13.1 We will collect and process your personal information in order to manage your booking, deliver the Service, handle payments and communicate with you.
13.2 Your information will be handled in accordance with applicable data protection laws in the United Kingdom. We will take reasonable steps to keep your personal data secure and to limit access to those who need it for the provision of the Service.
13.3 We may retain your contact details and Service history for administration, accounting and legal purposes for as long as reasonably necessary.
14.1 We may update or amend these Terms and Conditions from time to time. Any changes will take effect when posted or otherwise communicated to you.
14.2 The version of the Terms and Conditions that applies to your booking will be the version in force at the time you place the booking.
15.1 If any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable by a court or competent authority, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.
16.1 If we do not insist that you perform any of your obligations under these Terms and Conditions, or if we delay in doing so, that will not mean that we have waived our rights against you. Any waiver must be in writing to be effective.
17.1 You may not assign, transfer or subcontract your rights or obligations under these Terms and Conditions without our prior written consent.
17.2 We may assign or transfer our rights and obligations under these Terms and Conditions to another organisation, provided that this does not materially affect the Service you receive.
18.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.
18.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
